1. ENTIRE AGREEMENT - NO VARIATION WITHOUT PROPER APPROVAL
This is the entire agreement between the parties.  There are no collateral representations, warranties or any undertakings of any nature other than that written onto this form.  No person may verbally or in writing vary these terms or conditions or assign or transfer the Ad/s to a 3rd party without the approval in writing by Bridal Discount Book® (also referred to as BDB), and the order shall be construed strictly without taking into account any unauthorized variation.

It is understood that I am permitted to place my business details to this site providing I agree to the following (including but not limited to any items listed):

1. My business is for use by engaged couples
2. I am not a competitive business to this directory
3. I keep my advertised discount, saving &/or offer  completely exclusive to Bridal Discount Book®. NO duplication of my Bridal Discount Book® offer is stated elsewhere in any word, way shape or form.
4. My discount is available & honored on proof of a bride/groom membership number or on redemption of a printed version of my advertised voucher (if applicable subject to individual voucher conditions) presented to me at a members first contact. Either before my vouchers expiry and during my term as a listed advertiser on Bridal Discount Book®. I agree & understand that once my term / listing has expired, I am not authorised to provide further discounts or conduct any NEW business with or relating to Bridal Discount Book® or it's members.
5. I agree to honor my commitment, discount / saving for work which has been booked/secured prior to my business expiry but which may occur after expiry. 
6. Quoted prices are not alterable except in exceptional circumstances such as when I materially change a service or item's description. In such case the member concerned is entitled to the greater saving only before they have redeemed my business voucher, paid a deposit or signed a contract, whichever is applicable for securing said work. 
   Failure to do so will result in immediate cancellation of membership & removal of all advertising material and will incur a $50.00 administration fee.
   Please Note: Bridal Discount Book® employs the services of a mystery shopper. These shops are conducted at random with detailed reports, they will be unknown providing BDB's rules and regulations are upheld. Offending businesses will be seen as breaching their contract and immediate removal of all advertising material will follow with no remuneration.
   These shops are intended to ensure the continued success of BDB and all that use it.
7. All the compulsory fields are answered correctly to the best of my knowledge and are considered to be correct at the time of entering this information:
   must not be false, inaccurate or misleading;
   must not be fraudulent or involve the sale of counterfeit or stolen items;
   Infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
   violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, criminal law, ant discrimination or trade practices/fair trading laws);
   be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
   be obscene or contain child pornography or, if otherwise adult in nature or harmful to persons under the age of 18 years, shall be distributed only to people legally permitted to receive such content.
   contain any content that may be considered to be prohibited or potentially prohibited content for the purposes of the Broadcasting Services Act 1992 (Cth) (for more information about this legislation, please refer to the Internet Industry Association's Codes of Practice located at http://www.iia.net.au or http://www.aba.gov.au);
   contain any viruses, Trojan horses, worms, time bombs, cancel bots, Easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information.
8. Our Site contains robot exclusion headers and you agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained herein without our prior expressed  written permission. You agree that you will not use any device, software or routine to bypass our robot exclusion headers, or to interfere or attempt to interfere with the proper working of our Site or any transaction being conducted through our Site.
   You agree  that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure and will ensure subject to your chosen listing your uploaded picture files remain within:
   Silver = less than >60KB.
   Gold + National = <60KB upto 1MB
   ($5 fee for every file over limit)
   As stated in account under Create/Edit Your Advertisement Page & Voucher. Failure to do this will result in a charge of $5.00  for each file exceeding the upload limit.  Much of the information on our Site is updated on a real time basis and is proprietary or is licensed to Bridal Discount Book® by our users or third parties. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for Your Information) from our Site without the prior express written permission of Bridal Discount Book® or the appropriate third party authorised to grant such permission.
9. Create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
10. USE OF SOCIAL MEDIA (Facebook, twitter etc) - I understand that Bridal Discount Book® uses these as marketing tools only, intended to draw attention to the Bridal Discount Book® website. I agree when using other mediums to only draw attention to my official offer listed on my ad page on Bridal Discount Book®.

2. APPROVAL OF ADVERT
Bridal Discount Book® screens ' new ' business submissions / registrations to the best of our ability and reserves the right for any reason to decline any new business submission / registration without explanation.

Because of the nature of live updates all adverts are viewed by the customer instantly upon registration of business details at the location specified by you on the Bridal Discount Book® directory, consequently it is not possible for approval to be finalised until a listing has been submitted.

Therefore for any reason other than inappropriate content (refer below), Bridal Discount Book® declines or rejects a listing and payment has been made a full refund of fee's will occur. 

In the event your business is a group, conglomerate, corporation comprising of more than one business/company and you wish to advertise and offer a discount for all/both, example two hotels etc of the same name but residing in different areas; all must have their own separate advertising page under the relevant category/s.

Mention of a business service or name not listed with Bridal Discount Book® anywhere on your add page, offer or conditions is strictly prohibited. Failure to comply will result in immediate cancellation of membership & removal of all advertising material and will incur a $50.00 administration fee.

Advertisers manage their own accounts, including images and content.  It is the advertiser's responsibility to ensure that all images and content are copyright free and that they have permission to place this information on the Bridal Discount Book® website. Any mistakes approved or deemed approved by the advertiser shall not qualify for any compensation from Bridal Discount Book®.

3. PAYMENT PROCESS

PAYPAL
Bridal Discount Book® accepts on line payments via the PayPal payment system. PayPal lets you send payments using your credit card or bank account. The advantages of using PayPal are:

* Fast - Payments are processed and accepted immediately.
* Security: PayPal never shares information with anyone, therefore you can have greater confidence when making transactions.
* PayPal guarantees 100% protection against unauthorised payments sent from your account.
* Nobody at How Divine will see your credit card details, as we do not process credit card payments, this is all done via PayPal.

Choosing payment via PayPal will also have your add page listed immediately.

Electronic Funds Transfer (EFT)
Organized via Direct Debit between financial institutions.

Business
Please note in the event of EFT payments: Unpaid accounts 7 days from submission are void and removed from Bridal Discount Books database. Any specials that may have occurred 7 days prior are also invalid.  

Your advertisement won't be actively displayed until your payment clears, please allow around 3 to 5 working days. Once cleared & approved you'll receive a ' Welcome to Bridal Discount Book ' email with further instructions.

4. DEFAULT OF PAYMENT
The advertiser agrees to a dishonor and administration charge of
$30.00 on each dishonored payment.

5.  FRAUD.5.1 Without limiting any other remedies available to Bridal Discount Book® at law, in equity or under this Agreement, Bridal Discount Book® may, in its sole discretion, suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or
otherwise in our sole discretion) have engaged in fraudulent activity in connection with our Site.

5.2 MANIPULATION.
Neither you, nor any other member or seller may manipulate the price of any item once downloaded or collected.

6. EDITORIAL - MANUAL ERRORS OR OMISSIONS & CHANGES BY BDB
While every effort is made to check the accuracy of adverts / editorial content, prices, business name, addresses, telephone numbers etc, no compensation will be given for positioning of advert / editorial, errors or omissions made in the advert / editorial.  If requested, failure to supply advert / editorial material by deadline date shall dis entitle the advertiser from any promised advert / editorial space without compensation.  Where a request is made for added premiere advertising space, the charge made is for the total advertising over the 12 month period.  Any errors in or omissions of such space shall not entitle advertiser to compensation.

7. SPECIAL REQUEST / PLACEMENTS
In regard to special requests or placements, NO GUARANTEE is given that such requests or placements will be complied and such request/s or placements shall not be construed as a condition or term of their advertising order and accordingly, no claim for compensation will be allowed for any non-compliance.

8. BRIDAL DISCOUNT BOOK® RIGHTS / LIABILITIES
The advertiser acknowledges that Bridal Discount Book® at its discretion shall be entitled without notice or compensation to do any of the following.

Bridal Discount Book® reserves the right to modify, remove or decline any item on this site - this includes any discount vouchers, business profile pages or registrations received or created.

If on review, the content you have provided is viewed as inappropriate; we reserve the right to refuse the content. If we believe this content is extremely inappropriate we may remove your account. In removing your account, you have broken this agreement and forfeited any monies that you have paid to Bridal Discount Book® & associates.

Bridal Discount Book® shall not be liable in any way for any copyright infringements of written information or photographs that have been supplied by an advertiser.  It is the advertisers responsibility to ensure that all information and photographs supplied have been approved for advertising by the copyright owner.

9. CANCELLATION OF PRIORITY ADVERTISEMENT / REFUND POLICY

1. All cancellations of any advertising package must be made in writing within 10 business days.
2. No refunds are given in part or whole; if written cancellation has not been received within 10 business days of becoming an advertiser on this site.
3. All refunds incur a $50.00 administration fee.
4. Bridal Discount Book®, reserves the right to cancel any advertising on this site at our discretion and without any compensation.

10. INDEMNITY / TRADE PRACTICES
The advertiser understands that if promoting their business within a competition on the Bridal Discount Book® web site, it is the advertiser's responsibility and legal obligation to obtain any necessary permits that may be required.  It is also the advertiser's responsibility and legal obligation to ensure that the advertised prize for their competition is available for collection by the winner on the advertised competition expiry date.

The advertiser agrees that if attending any Bridal Discount Book® expo or events as an exhibitor, it is the exhibitor's responsibility and legal obligation to ensure that they have the appropriate liability insurance for their business in order to take part in these expos or events.

The advertiser indemnifies and agrees to hold indemnified Bridal Discount Book® , its servants and agents against all liability, claims, actions, demands proceedings, losses, damages, costs including solicitor and client costs and expenses which Bridal Discount Book®, its servants and agents, may suffer incur or sustain in connection with or arising in any way out of the publication or error in publication or any material or editorial pursuant to the order and, without limiting the generality of the foregoing, to indemnify and hold indemnified each and all of them against any action for defamation, slander, passing off, breach of copyright, or infringement of any trademark, name of description, invasion of privacy or breach of any provision of the Trade Practices Act, 1974.
These Terms and Conditions are governed by the laws of each and every Australian State and Territory and each party is governed by the non-exclusive jurisdiction of the State or Territory courts where their business or listing originates.
